Terms of Service

Agreement

These Terms of Service (the “Terms”) are an agreement between you and Habit Pocket, operated by Bohdan Stefaniuk(“we,” “us,” or “our”), a sole proprietorship based in Ontario, Canada, covering your use of the Habit Pocket apps, websites, and services (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

The Service

Habit Pocket is a habit tracker for checkmarks, numeric metrics, and times of day. You can use it on the web at habitpocket.io and on iOS. The free tier includes up to five habits. The Pro tier unlocks unlimited habits, the candle chart, the chart builder, and other features described on the pricing page. Sync across devices is free.

We may add, change, or remove features over time. Where reasonably practicable, we'll tell you in advance of a change that materially reduces what Pro gives you.

Eligibility

You must be at least 13 years old and old enough to enter into a binding contract in your country to create an account. Where local law sets a higher age for online services, the higher age applies.

Your account

You're responsible for the activity that happens under your account, for keeping your sign-in credentials confidential, and for keeping your email address up to date so we can reach you. Tell us right away if you think someone else is using your account.

Acceptable use

When using the Service, please don't:

  • Break the law, infringe anyone's rights, or store anything illegal
  • Try to access another person's account or data
  • Probe, scan, or attack the Service, or interfere with its normal operation
  • Scrape, mirror, or resell the Service or its content
  • Reverse-engineer the Service except where applicable law expressly allows it
  • Use the Service to send spam, malware, or harassing content
  • Use the Service to build a competing product or to train machine-learning models

We may suspend or terminate accounts that violate these rules, especially when the behaviour puts other users or the Service at risk.

Your content

Your habits, entries, sections, and chart configurations are yours. You keep all ownership and rights in the content you create. You grant us a limited, worldwide, royalty-free licence to host, store, transmit, back up, and display that content for one purpose only: running the Service for you across your devices. This licence ends when you delete the content or close your account, except for the short backup-rotation period described in our Privacy Policy.

We do not use your content for advertising, profiling, or to train machine-learning models, and we do not sell it to third parties.

Subscriptions and billing

The free tier is free. Pro is offered two ways: a recurring monthly subscription, or a one-time “Lifetime” purchase that unlocks Pro permanently with no recurring charge. Where you buy determines who handles billing:

  • iOS (App Store): billing, renewal, and refunds are handled by Apple under the Apple Media Services Terms. Manage or cancel your subscription in iOS Settings › Apple ID › Subscriptions.
  • Web (Stripe): billing is handled by Stripe. Manage or cancel your subscription from Settings › Billing. We never see or store your card number.

Auto-renewal. Monthly subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the period. Cancellations take effect at the end of the current period; you keep Pro until then and won't be charged again. The Lifetime purchase is a single payment that does not renew — there is nothing to cancel.

Free trial. If we offer a free trial, your subscription will start at the end of the trial unless you cancel before it ends.

Refunds. Pro unlocks digital content you can use right away, so our refund policy is:

  • Monthly:cancel any time and you keep Pro until the end of the period you've already paid for. We don't refund the unused part of a billing period that has already started.
  • Lifetime (one-time):as a goodwill policy we'll refund a Lifetime purchase in full if you email us within 14 daysof buying, and we'll remove Pro access. After 14 days the Lifetime purchase is final and non-refundable, except where applicable law requires otherwise.
  • App Store:refunds are governed by Apple's policies and requested through Apple, not us.

For web purchases, email habit-pocket@stefaniuk.me and we'll sort it out quickly — almost always faster than a bank dispute.

For EU and UK consumers, you have a statutory 14-day right of withdrawal for digital content. By starting to use Pro immediately after purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose the right of withdrawal once we begin providing the Service.

Chargebacks and payment disputes. If you think a charge is wrong, please contact us at habit-pocket@stefaniuk.me before disputing it with your bank — billing mistakes are almost always faster to fix directly. If a payment on your account is disputed with the card issuer, or our payment processor or the card networks flag it as fraudulent, we may refund the payment, revoke Pro access (including any active subscription and any Lifetime grant), and suspend the account while we review what happened. If your account is suspended this way, you can submit an unlock request from the sign-in screen and we'll review it. We may decline to restore access for accounts associated with fraudulent or repeatedly disputed payments.

Price changes.If we change subscription prices, we'll notify you in advance, and the new price will apply only to renewals after the notice period. You can cancel before the new price takes effect.

Taxes. Listed prices may not include taxes. Where applicable, taxes are added at checkout or collected by the app store on our behalf.

Mobile app licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use the mobile app on devices you own or control, for personal use, subject to these Terms and the rules of the relevant app store. For iOS, your use is also governed by Apple's standard Licensed Application End User Licence Agreement. If anything in that EULA conflicts with these Terms, the EULA controls for the iOS app only. Apple is not responsible for the app or for support or claims relating to it. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they apply to your use of the iOS app, and on your acceptance Apple has the right to enforce them against you.

Our intellectual property

The Service itself — the apps, the website, the design, the code, the Habit Pocket name and logo — is ours and is protected by intellectual-property laws. Nothing in these Terms transfers any of that to you, except for the limited licence to use the Service while your account is active.

Termination

You can stop using the Service at any time and delete your account from Settings › Account › Delete account. We may suspend or terminate your access if you materially violate these Terms, if a payment on your account is disputed or flagged as fraudulent (see “Chargebacks and payment disputes” above), or if we're required to do so by law. Where reasonable, we'll give you notice and a chance to fix the issue first.

Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and governing law — will continue to apply.

Disclaimer

The Service is provided “as is” and “as available.” We do our best to keep it reliable, but to the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. Habit Pocketis a habit tracker — it isn't medical, financial, or therapeutic advice, and you shouldn't rely on it as such.

Limitation of liability

To the maximum extent permitted by law, Habit Pocketwill not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) twenty-five Canadian dollars (CAD $25). Some jurisdictions don't allow these limitations, so they may not apply to you in full.

Indemnification

You agree to indemnify and hold Habit Pocketharmless from any claim, damage, or expense (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of someone else's rights.

Resolving disputes

Please email us first. Before bringing a formal claim, email us at habit-pocket@stefaniuk.me and give us 30 days to try to resolve it. Most issues we hear about can be sorted out this way.

If you're in the United States — please read this carefully. You and Habit Pocketagree that any dispute arising out of or relating to these Terms or the Service that we can't resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either of us may bring an individual claim in a small-claims court if it qualifies. You and Habit Pocket waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding. You can opt out of this arbitration clause within 30 days of first agreeing to these Terms by emailing habit-pocket@stefaniuk.me with the subject “Arbitration opt-out.” Opting out doesn't affect any other part of these Terms.

If you're outside the United States. Disputes will be resolved in the courts of the Province of Ontario, Canada, subject to any mandatory consumer rights you have in the country where you live.

General

If any part of these Terms is found unenforceable, the rest still applies. If we don't enforce a right one time, we haven't given it up. We aren't liable for delays or failures caused by events beyond our reasonable control (for example, network or platform outages, natural disasters, or government action). These Terms and the Privacy Policy are the complete agreement between you and us about the Service and replace any prior statements about the same subject.

Changes to these Terms

We may update these Terms from time to time. The updated version goes on this page and the “Last updated” date at the top changes. If changes are significant, we'll notify you by email or in the product. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. If you're a consumer, this choice doesn't deprive you of mandatory protections you have under the law of the country where you live.
